Please read these Terms of Service ("Terms") carefully before using fosterfund.com (the "Service"). By creating an account, submitting an application, or using any part of our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About FosterFund

FosterFund is an online matching platform that connects prospective dog foster parents with rescue organizations seeking temporary homes for dogs in their care. FosterFund is a technology intermediary only. We do not own, house, transport, train, or take custody of any dog. We are not a rescue organization, shelter, animal welfare agency, or veterinary provider. All fostering arrangements are made directly between foster parents and rescue organizations.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. FosterFund is not liable for any loss resulting from unauthorized use of your account.

4. The Matching Service

FosterFund provides a platform to facilitate introductions between foster parents and rescue organizations. We make no guarantees that:

You will be matched with a dog or rescue organization
Any match will result in a completed fostering arrangement
Any dog is suitable for your household or circumstances
Any rescue organization has met any particular standard of care or licensing

FosterFund does not vet, certify, endorse, or supervise any rescue organization listed or matched through our platform. You are solely responsible for performing your own due diligence on any rescue organization and any dog before entering into a fostering arrangement.

5. Limitation of Liability and Disclaimer of Warranties

FOSTERFUND IS A MATCHING PLATFORM ONLY. WE ARE NOT A PARTY TO ANY FOSTERING AGREEMENT BETWEEN YOU AND A RESCUE ORGANIZATION. TO THE FULLEST EXTENT PERMITTED BY LAW:

FOSTERFUND MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, ANY MATCH, ANY DOG, OR ANY RESCUE ORGANIZATION.
FOSTERFUND IS NOT LIABLE FOR ANY INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER HARM CAUSED BY OR TO ANY DOG PLACED THROUGH THE SERVICE.
FOSTERFUND IS NOT LIABLE FOR THE CONDUCT, ACTIONS, OR OMISSIONS OF ANY RESCUE ORGANIZATION OR FOSTER PARENT.
IN NO EVENT SHALL FOSTERFUND'S LIABILITY EXCEED THE AMOUNT YOU PAID, IF ANY, TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

The Service is provided "as is" and "as available" without warranty of any kind.

6. User Responsibilities and Conduct

By using the Service, you agree to:

Provide accurate, truthful, and complete information in your application and account
Comply with all applicable laws regarding animal care, welfare, and ownership
Treat all animals in your care humanely and follow the guidelines of the rescue organization
Not use the Service for any unlawful purpose or in any way that could harm animals or other users
Not misrepresent your living situation, experience, or ability to care for a foster dog

FosterFund reserves the right to suspend or terminate your account for violation of these terms or for any conduct we determine, in our sole discretion, to be harmful to the Service or its users.

7. Application Waiver

As part of submitting a foster application, you will be required to affirmatively accept our liability waiver, confirming that:

You understand FosterFund's role is limited to facilitating matches
You assume all risk associated with fostering a dog
You release FosterFund from any and all claims arising from your fostering experience

This waiver is a condition of submitting an application and using the matching features of our Service.

8. Intellectual Property

All content on the FosterFund platform, including text, graphics, logos, and software, is owned by or licensed to FosterFund and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Third-Party Services

The Service may contain links to or integrations with third-party websites and services. FosterFund is not responsible for the content, privacy practices, or terms of any third party. Your use of third-party services is at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless FosterFund and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your fostering activities.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which FosterFund operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that state.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.
